Search Brooke County Court Dockets

A Brooke County court docket is the running public record of a case, including filings, settings, and outcomes that the law permits the public to see. To search the Brooke County court docket, first identify whether the matter belongs to Circuit, Family, Magistrate, or a city municipal court. West Virginia provides separate public search paths for Circuit and Magistrate cases, while municipal records remain with each city. The Brooke County court docket may answer a date or status question online, but the clerk remains the source for certified copies, older files, and help when a record is restricted or absent.

Three Brooke County Docket Search Layers

No single Brooke County database holds every court docket. Circuit, Magistrate, and municipal courts each form their own public layer. WVPASS covers the first layer. MCR covers the second. Weirton, Wellsburg, Follansbee, Bethany, and Beech Bottom handle the third through city contacts.

The West Virginia Judiciary posts a court-record access landing page. It keeps Circuit and Magistrate searches apart. That official page shows why picking the right branch comes first.

The split matters for results. A blank screen in one system never proves that no Brooke County case exists, only that you searched the wrong layer.

What a Court Docket Shows

Think of a docket as the event index for a case. It identifies the case and traces its path. It may not equal the full case file, though. Which fields the public sees depends on the court and access level. MCR can list documents. The files themselves stay offline. WVPASS sells access to public Circuit document pages.

Case NumberThe court's unique case key; official help does not publish one universal Brooke format.
PartiesNames tied to the matter and, where shown, their roles.
Docket EntriesA dated list of pleadings, orders, notices, and events.
Hearing SettingsDate, time, judge, courtroom, or setting type when displayed.
Court and StatusThe court holding the record and its active, closed, public, or nonpublic state.
DispositionThe recorded result, which is distinct from the first allegation filed.

One caution applies. A docket entry proves an event was recorded, not that every claim in a filing was found true. For legal use, get the order or certified disposition from the clerk.

WVPASS and Brooke County Circuit Dockets

WVPASS is the public doorway into West Virginia Circuit Court records. Free registration, email verification, and two-factor authentication come first. Browsing cases costs nothing. Coverage begins with public Circuit cases filed on or after July 1, 1999. Anything older in Brooke County must go through the Circuit Clerk.

The official WVPASS gateway presents its controls after login. Stick to what the public help confirms for a Brooke County search.

Party name and case number both work as search terms. WVPASS confirms other filters exist without listing their labels in public help. Search History keeps your frequent cases handy, and Purchase History holds bought documents for 30 days.

Which Courts Keep Dockets

Brooke County sits in the First Judicial Circuit alongside Hancock and Ohio counties. Circuit Court takes felonies, major civil matters, lower-court appeals, and general-jurisdiction work. Family Court is specialized. Magistrate Court keeps its own lower-court docket. Municipal courts handle city ordinance and city-processed traffic cases.

Federal cases belong to the Northern District of West Virginia and PACER. Those systems carry no Brooke County state dockets.

Brooke County Docket or Document Index

The County Clerk's IDX Document Inquiry can masquerade as a county-wide search. It is not a court docket, though. Deeds, liens, estates, marriages, births, and deaths fill that index. Those records belong to the County Clerk. Circuit and Family cases belong with Circuit Clerk Glenda Brooks. Magistrate cases belong with Magistrate Clerk Traci Bright.

Do not treat “no result” as “no case.” A name missing from IDX may appear in WVPASS, MCR, or a municipal docket because the systems hold different records.

The Magistrate Fine and Payment System is not a docket search either. It works only by exact match on a Citation ID, Case ID, or Payment Plan ID. So it can help once a matter is identified, but it does not replace MCR.

Finding Court Dates and Settings

Begin with the newest docket entry or order. A setting may show a date, time, courtroom, judge, and purpose, and a later continuance or reset can still wipe it out. For Circuit and Family matters, confirm with the Circuit Clerk or the judge's office. Magistrate matters? Call the Magistrate Clerk. Municipal matters go back to the city court.

Brooke County posts no single consolidated daily calendar. Weirton lists a recurring Wednesday municipal session, but that schedule can change. Other cities may offer only a judge's name or a phone contact. Trial Court Rule 2.01 sets Brooke Circuit terms to begin on the first Monday in March, June, and November, and a term is not one case's hearing date.

Setting
A scheduled court event.
Continuance
An order moving an event later.
Reset
A changed setting, not a dismissal.
Disposition
The recorded resolution of a charge or claim.

The Brooke County court calendar walks through the full date-check path. Whatever the source, verify the latest setting with the named court.

MCR Limits Brooke County Docket Results

MCR is free. After a terms and CAPTCHA gate, it searches Magistrate records by first name, last name, or case number. Official instructions say it returns up to 30 records. That cap bites with common names. Use the case number when you can. You can also call the Magistrate Clerk instead of assuming a record is missing.

A result can show county, filing date, charge, disposition, and a document list. The documents themselves stay offline. For a complaint, order, disposition, or certified copy, contact Traci Bright at 304-737-1321. Her office can also tell you whether an older file sits on paper. It may instead live in another format. Note: a result limit or CAPTCHA gate constrains the search, not the underlying court docket.

Public Access to Dockets

West Virginia law leans toward open court records. Statutes, court rules, and sealing orders still set real limits. Anyone may inspect an electronic docket. The same person may read nonsealed and nonconfidential e-filed documents and buy paper copies for lawful fees. A Freedom of Information Act request works best when it names the record precisely and goes to the office that actually holds it.

Key rules:

Trial Court Rule 15A.26 covers public electronic dockets and nonsealed e-file records.

W.Va. Code §51-4-2 opens court records to inspection unless another law restricts access.

W.Va. Code §29B-1-3 sets a five-day FOIA response limit, excluding weekends and legal holidays.

W.Va. Code §§49-5-101 and 49-5-103 generally protect juvenile records.

Some files stay out of view. Family, juvenile, sealed, expunged, and nonpublic material can be withheld or missing even when the case itself exists.

When a Brooke County Docket Is Missing

Start with the basics. Check the court level and the spelling of the name. Compare the filing date against what WVPASS covers, and remember MCR caps its results. A city ticket may sit in a municipal court rather than Magistrate. Cases also move on appeal. Some get filed in another county, or survive only in older paper or microfilm collections.

Next, call the clerk who keeps that type of record. Give the court, case number, style, rough year. Then name the exact document or setting you want. Ask whether the file is public, nonpublic, sealed, expunged, juvenile, confidential Family Court material, or archived, and whether inspection or a plain or certified copy is available.

A gap in the online docket proves nothing. The court and the clerk control the record and its legal status, and an omission is not a ruling and not proof that no matter existed.

The Clerk and Docket Records

Glenda Brooks serves as Brooke County Circuit Clerk. She is the record keeper and fee officer for Circuit and Family Court. Her office holds civil, criminal, divorce, custody, support, guardianship, mental-hygiene, domestic-violence, juvenile, and lower-court appeal files, though access varies by type. Traci Bright is the separate Magistrate Clerk.

Requests reach the office through WVPASS or MCR, in person, by phone, fax, mail, or a specific written records request. The office posts no standard certified-copy form. There is no full fee sheet, email intake, drop box, or promised turnaround. Call first. Weekday hours run 8:30 a.m. to 4:30 p.m.

Brooke County Dockets Go Digital

Brooke County records have traveled a long road. They went from bound docket books and clerk indexes to statewide systems. The red-brick courthouse in Wellsburg, built in 1849, was the county's second. Its octagonal cupola holds the bell from the first. Along the way, filings passed through paper, microfilm, and computers, and the county publishes no full list of what has been digitized.

Statewide CourtPLUS and E-File reached completion in 2024, standardizing case management for Circuit and Family. MCR arrived in January 2024. WVPASS went live in March 2025 across all 55 counties. CourtOne, announced in October 2025, would unify the lower courts someday, but the announcement alone is not proof that a new Brooke public search is running.

Each tool also serves a different user. Circuit and Family E-File is role-based, aimed at attorneys, government staff, and other authorized filers, so it is not the public docket search. WVPASS is where the public views Circuit records. MCR is the public window into Magistrate information. The payment site only pulls up a case after you already hold an identifier. Confusing these roles leads to false dead ends.

Practical limits remain even now. WVPASS offers no bulk downloads and no case notifications. Its accounts carry security controls with inactivity timeouts. MCR puts no document images online. Neither system takes the original file away from the Brooke County clerk, who still holds it. Use the current portal first, keep the clerk as the fallback, and remember that no technology puts every old, sealed, municipal, or confidential record on the internet.

Brooke County Docket Volume

How much does this court handle? The most detailed official county figures appear in the 2013 Judiciary Annual Report. Treat them as history, not current counts. They show why one Brooke County docket is really several dockets: Circuit Court's mix leaned civil, Magistrate Court took on far more new matters with most of them criminal, and Family Court carried its own separate stream.

523new Circuit cases in 2013
348new Family cases in 2013
3,838new Magistrate cases in 2013

Circuit filings broke down as 63.1 percent civil, 22.4 percent criminal, and 14.5 percent juvenile. Magistrate filings ran 84.2 percent criminal, 10.2 percent special proceedings, and 5.6 percent civil. The dashboard itself labels these near-real-time counts preliminary and subject to revision.

Court Dockets by City in Brooke County

Each city keeps its own docket. The five pages below follow the official 2020 Census rank. Weirton has a court page and calendar. Wellsburg lists a City Judge. Bethany runs an ordinance court, and Beech Bottom lists a fine route. Follansbee offers no reliable current docket portal.

Weirton Court Docket

19,163; municipal court meets Wednesdays, subject to change.

Follansbee Court Docket

2,848; confirm the current court and clerk.

Wellsburg Court Docket

2,450; the City Judge is the municipal contact.

Bethany Court Docket

781; Ordinance 101 establishes public sessions.

Beech Bottom Court Docket

553; fine payment is available, but no case search was found.

Those figures come from the 2020 Census. Population rank never decides which court owns a case. Follow the court name printed on your notice.
